I applied for an asylum-based work permit after waiting the required time, but my application is still pending and my current permit is close to expiring. I am worried about losing my job and falling out of compliance. I filed everything correctly and on time, but I don’t understand what happens if USCIS does not decide before the expiration date. Can I continue working, and what should I tell my employer?

In many asylum-based categories, filing a timely renewal can automatically extend work authorization for a certain period. Your receipt notice usually explains whether you qualify for this extension. Employers are allowed to rely on the expired card together with the receipt notice if the category permits it. You should review the notice carefully and share the relevant information with your employer’s HR department.

USCIS delays are common, and many applicants face gaps between filing and approval. The key is whether your category qualifies for automatic extension. If it does, you remain authorized to work during that period. If it does not, you must stop working when the card expires to avoid violations. Clear communication with your employer is important to protect yourself.

I experienced the same situation and was extremely worried. Once I showed my employer the receipt notice and explained the automatic extension rules, they allowed me to keep working. Immigration delays are frustrating, but following the rules and documenting everything helps protect your status and employment.
