I am from Greece and recently relocated to Indiana. I entered the U.S. on a visitor visa to explore opportunities, but I have now received a job offer from a company here. The employer is willing to sponsor me, but I’m not sure what the best path forward is. Can I change my status directly in the U.S. to a work visa like H-1B, or will I have to return to Greece for consular processing? I am also worried about the timelines because the company wants me to start soon, and I don’t want to make any mistakes that could hurt my chances of staying legally.

Changing status from a visitor visa to a work visa inside the U.S. is possible but can take time and comes with strict requirements. In many cases, consular processing in Greece is faster and more reliable.

Most employers prefer consular processing because it avoids delays and complications with a change of status inside the U.S.

Since you entered on a visitor visa, USCIS will closely review your timeline and intent before approving any change to a work visa. If the H-1B is the option your employer chooses, you may face long waits due to the lottery system and annual caps. In many situations, returning to Greece for consular processing ensures a smoother approval process and avoids issues with overstaying. On the other hand, if you qualify for a different visa type, such as an L-1 (intra-company transfer) or O-1 (special skills), a change of status could be pursued in the U.S. It’s best to evaluate your employer’s options with an immigration attorney before making the next move.
