I am eligible for the voluntary departure stipend but worry I might not be able to return to the U.S. in the future. How should I weigh the risks and benefits?

It is important to understand that while the stipend provides financial support for departure, participation can affect your future eligibility for visas or green cards. Before signing up, consider your immigration history, including any prior unlawful presence or overstays. Voluntary departure may trigger reentry bars for three or ten years in some cases. If you want to return to the U.S. later, it is best to speak with an attorney who can review your history, explain risks, and advise on whether participation aligns with your long-term goals.

Deciding to participate should not be based solely on the stipend amount. Consider whether you may want to return to the U.S. through a visa or green card in the future, and how voluntary departure could impact that. Some departures are straightforward and allow future lawful entry, while others may trigger additional scrutiny or require waivers. Taking time to understand the legal implications and discussing your situation with an immigration professional will help you make an informed decision.
