Hi, I’m from South Korea and currently finishing my degree in the U.S. I’ve been talking to a tech company that wants to sponsor me for an H-1B job visa right after graduation, but I keep hearing about the lottery, deadlines, and how competitive the process is. I’m unsure when exactly they should start the paperwork and whether I’m allowed to stay and work while we wait. What should I know before moving forward with the H-1B process?

Your employer should register you for the H-1B lottery during the spring and file the petition if selected.

If you’re on F-1, Optional Practical Training (OPT) can allow you to work while waiting for the H-1B approval. The “cap-gap” rule may let you stay legally until the H-1B becomes active.

Timing is critical, so your employer should start preparing early to meet USCIS deadlines. The lottery does not guarantee selection, so it’s smart to have backup plans like extending OPT or exploring other work visas. You must maintain valid status at all times while waiting. Working without authorization could seriously harm your case.
