Hi, I’m from Azerbaijan and I entered the U.S. on a B-2 tourist visa about a month ago. Due to some personal issues back home, I’m now thinking about applying for asylum. Is it possible to apply while I’m still in the U.S. on this visa?

Yes, you can apply for asylum while in the U.S. on a B-2 visa, but you must file within one year of your arrival.

Yes, you can apply for asylum while on a B-2 visa if you fear persecution in your home country.

Make sure to apply within one year of arriving in the U.S. to stay eligible.

Yes, applying for asylum from within the U.S. on a B-2 visa is allowed, regardless of your current visa status.
