Growing up in Eritrea, I always dreamed of building a life in the United States. I’ve been here for over two years but recently fell out of status. I’m now planning to settle down with my boyfriend, who is a green card holder. What immigration options do I have to adjust my status and legally remain in the U.S.?

You may be eligible for a family-based petition through your boyfriend if you marry. Adjustment of status depends on meeting eligibility criteria and maintaining lawful entry.

Falling out of status complicates the process but does not always prevent a petition. Waivers may be available in certain circumstances.

A marriage-based green card requires proving a bona fide relationship. You will need to gather documentation of cohabitation, financial support, and shared life experiences. The process involves USCIS forms, interviews, and possibly consular processing if you leave the U.S. Consulting an immigration attorney can help navigate potential bars and maximize approval chances.
