Fear has started to shape every decision I make since my status expired. I entered the United States legally, but now I am out of status, and the situation around me feels alarming. Every person I arrived with who is also out of status has already been arrested, deported, or served with a Notice to Appear. It feels like only a matter of time before I am next. I am from Serbia and do not know what realistic steps are left for me. What should someone in my position understand about their rights, risks, and possible defenses before enforcement reaches them?

Being out of status does increase the risk of enforcement, but removal is not automatic. You still have the right to due process and, if placed in proceedings, to present defenses before an immigration judge. Understanding your options early can make a meaningful difference.

If you receive an NTA, attending all court dates is critical. Missing a hearing can lead to an automatic removal order.

Depending on your history, there may be options such as adjustment of status, asylum, cancellation of removal, or other forms of relief. Eligibility depends on factors like length of stay, family ties, and conditions in Serbia. You should begin gathering documents that show your presence, work, and community ties. Speaking with an immigration attorney or trusted legal aid organization as soon as possible is one of the most important steps you can take.
