Family relationships have changed a lot over the years, and now I am trying to understand how they affect my immigration future. I am from Senegal, and my mother is a U.S. citizen, even though she divorced my father years ago and is now married to another American. I am unsure whether her past marriage or current one matters for my situation. What options might be available to me through my mother, and does her remarriage affect her ability to help me immigrate?

Your mother’s U.S. citizenship is the most important factor in family-based immigration. Her divorce or remarriage does not take away her ability to petition for her child.

Your age and marital status determine which family category applies to you. Unmarried children under twenty-one have the fastest path. Adult children can still be sponsored but face longer waiting times.

Proof of your biological relationship to your mother will be required. Her current marriage does not negatively affect your case. Processing times vary by category and country. An immigration attorney can help you understand timelines and prepare the petition correctly.
