An individual with a pending asylum application may apply for EAD 150 days after filing Form I-589. However, USCIS cannot approve the work permit until at least 180 days have passed.

Pending asylum applicants are not authorized to work in the U.S. immediately. To gain work authorization, they must file Form I-765 no earlier than 150 days after filing Form I-589. The 180-day Asylum EAD Clock must be met before USCIS can approve the request. Once granted, the EAD allows lawful employment while the asylum application is under review.

Asylum applicants are eligible to apply for a work permit while their case is pending, but only after meeting specific timing requirements.
