Can I file an I-130 for my fiancé(e) instead of a K-1 visa?

No, you cannot file an I-130 for a fiancé(e). The I-130 petition is only available for spouses and other qualifying relatives. If you are not yet married, the appropriate option is the K-1 fiancé(e) visa, which allows your fiancé(e) to enter the U.S. for the purpose of marriage.

The I-130 petition is used for spouses, parents, children, and siblings—not for fiancé(e)s. To bring a fiancé(e) to the United States, you must file Form I-129F, Petition for Alien Fiancé(e). After your marriage in the U.S., you can then file an I-130 to start the green card process.

An I-130 petition cannot be used for a fiancé(e) relationship. If you are not yet married, you must use the K-1 visa process. Once you marry within 90 days of your fiancé(e)’s entry to the U.S., you may then file an I-130 to transition your spouse to permanent resident status.
