Yes. If you are granted an E-2 investor visa, your spouse and unmarried children under 21 years old can also apply for dependent E-2 visas. They are generally allowed to live in the U.S. with you for the duration of your E-2 status. Each family member must submit their own visa application and attend the visa interview, but they are not required to make a financial investment themselves.

E-2 dependent visas also come with benefits. Spouses of E-2 visa holders may apply for work authorization (an Employment Authorization Document, or EAD) once in the U.S., allowing them to work for any employer or even start their own business. Children under 21 can attend school or college in the U.S., but they are not eligible to work. Once children turn 21, they lose dependent status and must switch to another visa category to remain in the U.S.

Bringing your family is a straightforward process, but planning ahead is important. All family members usually apply together when the principal investor applies, though dependents can also apply later if needed. You should ensure that you maintain valid E-2 status, as your family’s status is directly tied to yours. If your E-2 visa is extended or renewed, your family members must also extend their dependent visas.
