Yes, you can apply for asylum while in immigration detention. If you tell immigration authorities that you fear returning to your home country, you will be given a credible fear interview with an asylum officer. If you pass, you may be allowed to present your asylum case before an immigration judge while still in detention or, in some cases, after being released on bond or parole. If you do not pass the credible fear interview, you can request that an immigration judge review the decision. Because detention cases move quickly and the stakes are high, having an immigration attorney or accredited representative is very important for preparing and presenting your asylum claim.
