In many cases, portability may be available under the American Competitiveness in the Twenty-First Century Act (AC21). If the I-140 is approved and the I-485 has been pending for at least 180 days, the applicant may change to a new job in the same or a similar occupational classification without restarting the entire green card process. The new position must be comparable in duties and skill level.

The 180 days rule may have to apply. They may not be able to do so unless it's 180 days after approval
