Back home in India, I’ve been in talks with a U.S.-based tech company that wants to hire me full-time. We’ve had several interviews, and they’ve even sent me a draft offer letter. But I haven’t been to the United States before, and I’m unsure what visa or process I’d need to start working legally. Should the company sponsor me for a visa, or is there something I need to do on my end before anything official begins?

You’ll likely need an employment-based visa such as the H-1B, which requires your employer to sponsor you. The company must file a petition with USCIS before you can apply for the visa at a U.S. consulate in India. Only after approval can you begin work in the U.S. legally.

The company should initiate the process by filing for your work visa sponsorship. You can’t begin employment or travel to the U.S. for work until that’s approved. Make sure the position meets the requirements for the visa type they plan to file under.
