After experiencing serious problems in my marriage with a U.S. citizen spouse, I am trying to understand whether the Violence Against Women Act could help me stay legally in the United States. Can I self-petition under VAWA, what basic requirements apply, and how might this affect my current immigration status?

Yes. VAWA is an available protection for spouses of citizens who are facing abuse

VAWA allows certain spouses of U.S. citizens or green card holders to self-petition without relying on the abusive partner. You must show a qualifying relationship, shared residence, and evidence of abuse or extreme cruelty. Approval can place you on a path toward lawful status.

A VAWA case is confidential and does not notify your spouse. It can also allow access to work authorization while the case is pending.

Each situation is fact-specific, so timing and prior immigration history matter. Speaking with an immigration attorney experienced in VAWA is strongly recommended.
