What if I get divorced before my spouse gets a Green Card?

If you're the U.S. citizen or Green Card holder and divorce before approval,the immigrant spouse may lose eligibility for a Green Card.

Divorce can end the immigrant petition Form I-130, without a valid marriage, USCIS may deny the case.

If the immigrant already has a conditional Green Card, they may still apply to remove conditions (Form I-751) with a waiver.

The immigrant spouse may qualify for a VAWA self-petition, if there was abuse during the marriage even without the U.S. spouse’s help.
