Legal Permanent Resident with a history of substance abuse absolved from immigration proceedings
Legal Permanent Resident absolved of immigration proceedings, after being placed in Deferred Inspection by Immigration and Customs Enforcement for previous conviction of a controlled substance offense. The attorneys at the Law Offices of N.M. Gehi, P.C. successfully argued that because his record was permanently sealed, the Department of Homeland Security would not be able to prove it was a controlled substance offense, and that the client would invoke his 5th Amendment privilege against self incrimination and not admit to a controlled substance conviction if he was placed in removal proceedings. The Department of Homeland Security released his Green Card and passport and did not place him in removal proceedings.
